3. Important note re OPP attempts to falsely link Mr. McHale to violence

Mayor Trainer: McHale will aid quest for peace, law and order, stability and justice.

“Despite the OPP’s and the McGuinty government’s attempts to cast McHale as a troublemaker, Haldimand Mayor Marie Trainer thinks his candidacy is positive. With McHale in the race, Trainer says Haldimand’s quest for peace, law and order, stability and justice will feature prominently in the coming campaign. She says McHale will force the other candidates to state their position on the issue of two-tiered justice. “He will keep the land claims issue in the forefront.””

During the past two years members of the Ontario Provincial Police, most notably Commissioner Julian Fantino, have issued public statements accusing Gary McHale of encouraging and participating in acts of violence in connection with his well-known protests against OPP policing practices. They have also attempted to claim that Mr. McHale’s protests have turned violent, and tried to imply that he is responsible for injuries to police officers. Unfortunately, some media have reprinted these serious allegations without verifying them or allowing Mr. McHale to clear his name following publication.

Here are the facts most of which are supported by sworn testimony by an OPP detective:

1. Gary McHale has NEVER encouraged, incited, desired or participated in ANY acts of violence in connection with his protests.

2. NO police officer or civilian has ever been injured at ANY protest organized by Gary McHale.

3. Mr. McHale’s only ‘involvement’ in violence has been as the victim of several unprovoked assaults by supporters of an illegal smokeshack in Caledonia on Dec 01/07, and as the victim of a false allegation of assault, also by a smokeshack supporter during the same protest.

4. NO violence has ever occurred at ANY protest organized by Gary McHale. The Dec 01/07 protest was organized by a Caledonia resident to protest the sale of illegal cigarettes to the town’s children and, with the exception of one minor pushing incident by another resident upset at an intrusive videographer, the violence of the day was perpetrated entirely by smokeshack supporters. 

5. Mr. McHale is a committed follower of the teachings of Dr. Martin Luther King Jr. with respect to the use of non-violent protests to confront injustice, and has demonstrated that commitment via his words as early as Jan 14/07 in a Caledonia townhall meeting and by his actions, particularly on Dec 01/07 when he refused to retaliate in kind against those who viciously attacked him with punches, kicks and hateful words.

6. On Dec 14/07 OPP Detective John Murray attempted to paint Mr. McHale and his protests as violent during a lengthy presentation to the court however, under cross examination by Mr. McHale he was forced to admit the truth – that he had no evidence supporting the OPP’s position. 7. On Dec 24/07 Haldimand Mayor Marie Trainer testified about how Commissioner Fantino tried to intimidate Council into not making favourable statements about Mr. McHale. She also stated that she did not see him as a violent person or a danger to her community, but as someone trying to be an advocate for the residents of Caledonia.

8. Two prominent OPP officers are facing lawsuits for their defamatory statements.

9. Two complaints related to defamatory statements by Commissioner Fantino were dismissed by the current and former Minister of Community Safety and Correctional Services without investigation.

In light of the evidence above the candidate respectfully requests that he be given an opportunity to address any ‘facts’ or allegations of a negative nature prior to publication.
